TERMS AND CONDITIONS

APPLICATION

The following document sets out the Terms & Conditions under which we, Le Motor Squad Ltd., offer our services to You, the customer.

Before placing an order on our website, you will be asked to agree to these Terms & Conditions by clicking on the button “I Accept”. Please ensure you have read all Terms and Conditions before confirming your order with us. 

 

TERMS

The following Terms shall apply. 

Us or We or Our refers to the Tour Operator who is Le Motor Squad Ltd. 

Tour Leader refers to the accompanying responsible person present for the duration of your Tour, under the responsibility of the Tour Operator.

Tour Guide refers to any accompanying riders present for the duration of your Tour, under the responsibility of the Tour Operator.

You or Participant or Customer refers to the user or viewer of our website and subsequent tour participant. 

Booking refers to the package you as a customer have ordered and paid for via our website.

Services means the services advertised on the Website, including any tours and goods, of the number and description set out in the Booking Confirmation; 

Privacy Policy means the terms which set out how we will deal with confidential and personal information received from you via the Website or email;

Website means our website www.lemotorsquad.com on which the Services are advertised.

Roadbook refers to the tour details as communicated to all participants prior to departure, and containing all details of your tour, including and not limited to trip itinerary, hotels, meals, visits, GPS points etc.

BOOKINGS

When you make a booking you guarantee that you have the authority to accept and do accept on behalf of all members of your party, under the terms of these booking conditions. The first named person on the booking will be the party leader and will be responsible for making all payments due to us. All bookings are made on a first-come first-served basis. Le Motors Squad Ltd reserves the right to decline any booking at their discretion.

 

DEPOSITS

All fees include VAT at the rate applicable at the time of the Booking. 

In order to confirm your place on a tour, a deposit per person is required.

All deposit payments can be made via direct bank transfer (contact us for details).

Upon receipt of your deposit and completed booking form where you must have accepted our Terms & Conditions, we will then reserve a place on your chosen tour.

All deposits are non-refundable and non-transferable, irrespective of circumstances.

 

PAYMENT OF BALANCE

Upon receipt of a completed booking form and deposit you will be issued with a confirmation notice and invoice via email which contains details of your tour reservation, our Terms & Conditions and the tour balance payment date. 

The balance of the tour price must be paid no later than 60 calendar days before the tour start date. Failure to pay will result in your reservation will be cancelled. 

Balance payment can be made via direct bank transfer (contact us for details).

Bookings made 60 days or less before the departure date will be accepted only with full payment or by prior agreement. Only those who have paid in full will be allowed to participate in the tour.

 

The 1992 Package Travel, Package Holiday and Package Tours Regulations require all holiday organisers to make provision for the protection of clients’ money in the event of the company’s insolvency. In accordance with the regulations Le Motorsquad Ltd will hold all clients’ money in a trust account until such time as your tour is completed.

 

 

TOUR PRICES & SERVICES

All Tours & Services which appear on the website are subject to availability at the time of booking. 

The description of our Tours and Services is as set out in the website, catalogues, brochures or other form of advertisement. 

Special arrangements that fall outside of listed services can be made for Customers. Once agreed, these must be confirmed in writing to Le Motor Squad Ltd. Any surcharges will be communicated and must be agreed in writing between the Customer and Le Motor Squad Ltd. and paid at the time of confirmation.

We reserve the right to make changes to the Services and Tours advertised which are necessary to comply with any changes to local laws. We will notify you of these changes. 

 

OUR RESPONSIBILITIES

Le Motor Squad Ltd is responsible for ensuring that any part of the tour programme booked, where it is within their control, is supplied as described in on the website and in the Roadbook. However, please be aware that during the tour some amenities (ie hotel lifts, swimming pools etc) may be inaccessible at times. We cannot be held responsible for some amenities being affected by local factors outside of our control. 

 

You will be provided with a Roadbook which includes a full itinerary, comprehensive GPS data, detailed maps and addresses of hotels and restaurants. Le Motorsquad Ltd makes reasonable efforts to ensure that the correct arrangements have been made for all the tours in the Roadbook and that the suppliers of services are as advertised. 

 

The guiding of all Tours is done purely at our discretion. We reserve the right to divide the tour party into groups based on ability. In only very exceptional circumstances, we may ask a participant to ride alone, but we would seek to avoid this where possible.

 

Le Motorsquad Ltd cannot be held responsible for death, personal injury or illness caused by activities engaged in which are outside the tour itinerary. We also cannot be held responsible for death, personal injury or illness howsoever caused unless we are shown to be negligent. We have no influence or control over your riding ability or skills, it is entirely your responsibility to ensure you are safe and riding within your own ability and abiding by local laws for each country. 

 

CUSTOMER RESPONSIBILITIES

Participation in any tour is entirely at your own risk. 

You are responsible for your motorcycle including mechanical or accident repairs. You are always responsible for yourself, or any pillion travelling with you. Any accident, bodily injury, illness or death to rider or pillion during your tour is not the responsibility of Le Motorsquad Ltd, it is your responsibility to hold personal travel insurance for both yourself and your pillion should you have one.

 

It is the Participants responsibility to ride their motorcycle in accordance with local laws, rules and regulations. Any motorcycle accident involving a Participant with an unrelated third party or another Participant, will never be the responsibility of Le Motorsquad Ltd.

 

When booking a tour we assume that the participant (and pillion if applicable) will have read the Roadbook and will be fully aware of the route, destinations and the approximate mileages for each day and will have made the judgement that it is an appropriate tour for them to undertake.

 

Our tour gradings have been given in good faith but without any responsibility to Le Motorsquad Ltd whatsoever. It is the Participants responsibility to choose the appropriate Tour to their skill level and ability. We cannot be held responsible if the Participant is out of their comfort zone in regards to the grading and difficulty of the Tour.

 

The following list sets out your obligations as a participant:

  1. You must be a competent rider with a machine that is road legal and of a type suitable for touring. It is your responsibility to ensure that your motorcycle is in a road worthy condition for the tour you are going to undertake.

  2. You must hold a valid driving license

  3. You must hold a valid passport and visa if required

  4. You must hold a valid Certificate of Insurance covering your Motorcycle, rider and pillion.

  5. You must have the ability to get you, your pillion and/or bike home in the event of a breakdown, accident or emergency.

  6. You must advise Le Motorsquad Ltd of any illness, medical conditions, allergies or dietary needs that may affect your tour.

  7. If you are not a European passport holder, you must hold a European Health Insurance Card (EHIC) which can be obtained online at www.dh.gov.uk/travellers or by post from any main Post Office.

  8. viii.You must hold the appropriate level of valid breakdown cover for your Motorcycle. This should include repatriation cover in the event of an accident or breakdown.

  9. You must hold valid personal travel Insurance for you and your pillion (if appropriate). This must include medical cover including any possible repatriation in the event of serious illness or accident. 

 

Le Motorsquad Ltd is not responsible for any disruption to your tour due to you failing to carry these documents or your loss of these documents. All additional direct and indirect costs incurred by the Participant to replace documents or because they cannot continue with the Tour are borne by the Participant and refunds will not be made for any part of the Tour missed.

 

CUSTOMER CONDUCT

We expect a level of competency and an ability to fully control your motorcycle at all times. You are expected to ride in a courteous and safe manner in respect to your fellow riders and other road users. If we feel you are not riding in a safe and courteous manner and putting other members of the group or other road users at risk we reserve the right at our absolute discretion to ask you to leave the tour group and ride alone.

 

We reserve the right at our absolute discretion to terminate your Tour without prior notice should your behaviour be such that it is likely in our opinion to cause danger, annoyance or damage to any other person or property.

 

We have a zero tolerance policy regarding any type of abuse. Any form of threatening behaviour, verbal, racial or physical abuse to another member of the group or towards any of our staff, contractors or tour leaders will result in you being expelled from the tour and your tour terminated.

 

In any of these circumstances the Participant(s) concerned will be required to leave the Tour and we will have no further responsibility to them including any return travel arrangements. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.

 

PERSONAL INJURY

Le Motor Squad Ltd is not responsible for any accidents. It is agreed and understood that neither Le Motor Squad Ltd nor its agents are the guardians of any customer’s safety and that they, individually or collectively, cannot be held liable in any way for any occurrence in connection with the tour, which might result in injury, death, or other damage to the customer, his property, or his family, heirs or assigns.

As a passenger/pillion, the customer is aware of the potential dangers of motorcycling.

 

CANCELLATION BY YOU

In the event that you need to cancel your booking with us, the following cancellation terms apply:

 

Cancellation Notice / Cancellation Fee

60 days or more / Deposit is non refundable, all other advance payments are 100% refundable.

30 to 59 Days / 50% of total tour price plus deposit is non refundable

0 to 29 Days / 100% of total tour price plus deposit is non refundable

 

All cancellation requests must be made in writing, either via email to hello@lemotorsquad.com or by post to the registered business address.

 

If the balance of the tour price is not paid by the due date (60 days before your tour commences), we reserve the right to cancel the tour and retain the deposit.

 

TRANSFER OF BOOKING

If a Participant, for any reason, is unable to travel the booking can be transferred to a third party subject to prior approval of the Tour Operator and where it is within our ability. In such cases at least two weeks’ notice should be given and the changes will be subject to any additional direct costs incurred.

 

CANCELLATION BY US

Le Motorsquad Ltd reserves the right, in any circumstances, to cancel your booking and will notify you as soon as reasonably possible. In such an event we would:

  1. offer you an alternative tour of equal or greater value OR

  2. offer you a voucher, valid for 24 months from date of booking, to the value of your deposit. 

 

FORCE MAJEURE

Means unusual and unforeseeable circumstances which are beyond normal control, the consequences of which could not have been avoided even if all due care had been exercised. Such circumstances or events include (but are not limited to) war, or threat of war, riot, civil strife, industrial dispute, unavoidable technical problems with transport, closure or congestion of airports, terrorist activity, natural or nuclear disaster, volcanic activity, fire and adverse weather conditions.

In the event of any of the above, refunds or compensation cannot be made and Participants will be responsible for providing all their own additional meals, travel and accommodation.

 

 

REFUNDS

All requests for refunds must be made in writing either via email to hello@lemotorsquad.com or by registered post to the registered business address (see above).

Refunds will be processed within 30 days of receipt of the request.

If a refund is approved, the funds will be paid within 15 days of approval, via bank transfer.

 

 

PHOTOGRAPHY

Photos and videos produced by Le Motor Squad Ltd or its representatives during a tour are the property of Le Motor Squad Ltd and copyrights remain with Le Motor Squad Ltd.

Le Motor Squad Ltd can use this material for promotional and advertising purposes, including images in which individual tour participants can be recognised, without consent or any charge for the use of this material.

If you wish to withdraw your consent, please inform us in writing prior to your trip and we will ensure you do not feature in tour photos.

 

 

USE OF PERSONAL INFORMATION

In accordance with data protection we hereby declare that we only collect information for the purposes of booking the tours. In collecting, storing and using your data provided, we comply with the UK General Data Protection Regulation (GDPR) laws in place.

If you wish for all information to be deleted or destroyed please let us know.

GOVERNING LAW, JURISDICTION AND COMPLAINTS

The Contract (including any non-contractual matters) is governed by the law of England and Wales.

Disputes can be submitted to the jurisdiction of the courts of England and Wales or, where the Customer lives in Scotland or Northern Ireland, in the courts of respectively Scotland or Northern Ireland.

 

COMPLAINTS

Should a Participant feel that we have not met our obligations as a Tour Operator, it should first be brought to the attention of the accompanying Tour Leader and we will endeavour to address all concerns appropriately.

If the Participant remains unsatisfied, any comments should be put in writing, within 30 days of return, quoting the tour name and tour dates to:

You should note that it is unreasonable to take no action whilst on a Tour, but to then write a letter of complaint upon return. If you fail to follow this simple complaints procedure (on tour and on your return home), we cannot accept responsibility as we would have been deprived of the opportunity to investigate the matter and hopefully rectify any problem.

 

DISCLAIMER

Payment of deposit or transfer of any monies to Le Motorsquad Ltd is considered acceptance of these terms and conditions. It is each participant’s responsibility to read and understand the terms and conditions.

 

TOURS DISCLAIMER

I have read and understood Le Motorsquad Ltd terms and conditions and I expressly agree to abide by their terms of business. 

I certify that my motorcycle is road legal and that I hold a valid certificate of insurance covering my motorcycle, rider and pillion (if applicable). 

I also certify I hold valid personal travel insurance and breakdown cover that includes the ability to get myself, my pillion (if applicable) and my motorcycle home in the event of illness, accident, breakdown or emergency and will cover any medical treatment that I (or my pillion) may need. 

I have read the tour roadbook and I have made the judgement that the tour is suitable for both me and my pillion (if applicable). 

I am fully aware of the route, destinations, approximate mileages, types of roads and I have made the judgement that the tour is appropriate to my experience level and ability. 

I understand that Le Motorsquad Ltd reserve the right at their absolute discretion to ask me to leave the tour group and ride separately from the main tour group.

 

RELEASE OF LIABILITY AND ASSUMPTION OF ALL RISKS.

I acknowledge that participation is entirely at my own risk and that motorcycling and travelling entails known and unanticipated risks. 

I also accept that such risks simply cannot be eliminated without jeopardising the essential qualities of the activity. The risks include, but are not limited to travelling in mountainous terrain, altitude, civil unrest, acts of god, forces of nature, biological warfare, pandemics, all forms of transportation, accident or illness in remote areas without means of rapid evacuation. 

I hereby release Le Motorsquad Ltd, their guides, any members of staff or contractors from any and all liability arising from physical or emotional injury, paralysis, illness, death, delays, loss or damage to property, or to third parties, recklessness of any kind, and from any and all claims, demands or expenses resulting from the tour. 

I expressly agree and promise to accept and assume all of the risks existing in this activity. 

I accept that participation in this activity is purely voluntary, and I elect to participate in spite of the risks. 

The above release of liability and assumption of all risks statement applies to all members of my family and are binding upon my heirs, legal representatives and assigns.
